Legal Protection

In some domestic abuse situations, you may be able to apply for a civil injunction or protection order to help protect you and your family.

Non-Molestation Orders

A Non-Molestation Order is a court order designed to protect you and any children from abuse, threats, harassment, intimidation or unwanted contact.

A Non-Molestation Order may prevent someone from:

  • Using or threatening violence
  •  Contacting you directly
  • Contacting you through other people
  • Harassing or intimidating your children
  • Coming to your home or workplace

Breaching a Non-Molestation Order is a criminal offence and can result in arrest.

 Occupation Orders

An Occupation Order is a court order that regulates who can live in a property.

Depending on your circumstances, it may:

  • Allow you to remain in your home
  • Restrict an abuser from entering the property
  • Require an abuser to leave the property
  • Define which areas of a home can be used by each person

An Occupation Order may be considered when it is unsafe for people to continue living together.
