I have received an Enforcement Notice from an Enforcement Agent

You have received this because of one of the following reasons:

  • You have broken an arrangement that you set up to pay off your debt under Liability Order
  • You failed to return an Information Request or have an arrangement confirmed on your debt under Liability Order in the timeframe given

Once a debt has been passed to the Enforcement Agents it will not be recalled by the Council unless there are extenuating circumstances and those circumstances can be proven.

The Enforcement Agent fees are as follows:

  • Compliance stage: £75.00

The fee of £75.00 is charged as soon as the case is passed from the Local Authority to the Enforcement Agent. The charge is payable on each Liability Order – this will be added to the debt as soon as it is passed to the Enforcement Agents and provided you make an arrangement and do not break it, this will be the only fee incurred

  • Enforcement stage: £235.00 plus 7.5% of the value of the debt that exceeds £1,500

The fee of £235.00 is payable upon first attendance at the premises. Only one enforcement fee may be charged even if there are multiple Liability Orders – this will only be added to the debt if you fail to make an arrangement or break an arrangement and the Enforcement Agent is required to go to your property

  • Sale stage: £110.00 plus 7.5% of the value of the debt that exceeds £1,500

The fee is payable upon first attendance at the premises to remove the goods or prepare for sale

Enforcement agents may also recover disbursement fees that are reasonably and actually incurred such as the cost of storage of goods removed and locksmith’s fees

The level of the fees is set by the Government and will be reviewed annually

The compliance fee will be taken before the arrears and once that is cleared all payments will go towards reducing the Liability Order. However, if further fees are incurred at any point then they will be taken on a pro-rata basis with the Liability Order once the compliance fee has been cleared.
