An application can be made for deductions to be taken from your benefit for any of the following reasons:
- You have broken an arrangement that you set up to pay off your debt under Liability Order
- You failed to return an Information Request or make an arrangement on your debt under Liability Order in the timeframe given
- You have requested deductions from your benefit to clear the debt under Liability Order
Deductions can only be made from the following benefit type:
- Income Support
- Employment Support Allowance
- Job Seekers Allowance
- Pension Credit Guaranteed Credit
- Universal Credit
The rules surrounding deductions are:
- Only one Deduction of Benefit Order can be issued for Council Tax at any one time
- Deduction of Benefit Orders can only be issued on debts under a Liability Order
- Deduction of Benefit Order cannot be issued on bills
- The Council cannot change the amount being deducted, it is government set at 5%
- ESA, JSA, Income Support and Pension Credit Guarantee Credit is usually £3.70 per week
- Universal Credit deductions are changeable and the DWP will advise you of the amount
If you have a Deduction of Benefits order running on a debt then you must still pay your bill and any other arrears alongside it
The Department of Work and Pensions will inform you and Tendring Council when deductions will start and finish. If there is still an outstanding debt then you will be contacted for an arrangement.
