What is the Local Plan?

One of the main duties of the District Council is to plan for the use of land in the Tendring District. The Replacement Local Plan is the document through which the Council has made designations for different types of land use over the period of time up until 2011, directing growth towards suitable areas and protecting the district from unsustainable or harmful development. It is called the Replacement Local Plan because it replaces the Adopted Local Plan of 1998.

How does it affect Planning Applications?

The Local Plan sets out the guidelines that are used in the determination of whether a planning application is refused or granted planning permission. Most development or change of land use, whether it is a small residential extension or a large shopping complex, will need planning permission. The Local Plan is the first consideration in determining a Planning Application because it gives guidance to our Planning Officers to ensure that the Council makes rational and consistent decisions. The Local Plan helps us to guide development in order to meet the needs of the community for new homes, jobs, shops and leisure facilities without spoiling our towns, villages, countryside or coastal areas.

How can I find out more about the Local Plan?

The Re-Deposit Draft of the Replacement Local Plan is available for members of the public to view at the Council Offices in Weeley and at the Town Hall in Clacton. It is also available to view at all of the local libraries in the District. If you choose, you can also view the Local Plan on our website by clicking on the relevant links, headed Local Plan. How can I get involved?

The Local Plan process requires a number of steps to be taken before it is finalised and becomes adopted. This enables the Council to have the chance to discuss our ideas with the public during various Public Consultation Periods. In fact, the Council encourages the local community to get involved in the process through making representations in support or objection to all parts of the Local Plan. By supporting or objecting to our Policies we can monitor which Policies are popular and which policies are in need of some alteration. Without your comments we do not know how you feel or what you want to happen in your local areas. Unfortunately, we can only consider representations that are made during the various Public Consultation Periods. These are held after each stage of the Local Plan process as shown below:

How was the Plan produced?

In producing the Re-deposit Draft of the Local Plan the Council has taken account of:

· National, Regional and County planning guidance and targets;
· the effectiveness of existing Local Plan policies;
· population, employment and development trends; and
· the views and needs of the local community, businesses and service providers.

In 2000, the Council produced an Issues Report that was made available to the public free of charge. Following the Issues Report we received over 1,000 responses. All of these representations were taken into account in the production of the Replacement Local Plan First Deposit Draft. During the First Deposit consultation period many representations were received and the Council has now completed its consideration of all of the comments and has agreed a number of changes to the First Deposit Draft.

These changes have been incorporated as part of an updated version of the Replacement Local Plan which is re-published on the 7th November 2005 as the Tendring District Replacement Local Plan, Re-Deposit Draft.

So what stage are we presently at?

The Tendring District Replacement Local, Re-deposit Draft is now ready for consultation. The six week consultation period starts from Monday 7th November until 12h00 on 19th December 2005. The Council will not be able to consider any responses received after 12 noon on Monday 19th December - so don't leave it too late!
