A large pine tree outside a property in Walton must remain, a Government Inspector has decreed.
Matthew Rouse applied for consent to fell the tree in Elliots Drive but Tendring District Council (TDC) refused permission last year.
Mr Rouse appealed against the Council’s decision in a bid to get it overturned but inspector Iwan Lloyd found in favour of TDC.
He said there was no evidence that the tree, which is subject to a preservation order, is unstable or that damage to drains was caused by the pine’s roots.
Mr Lloyd added that remedial work to remove a small section of dead wood could manage the situation and reduce the likelihood of any branches falling.
He considered the tree had a high amenity value and should remain in place.
