| My lender is threatening to take me to
court, how will the court deal with my
case? |
|
If you have been unable to reach an
agreement with your lender and you cannot maintain your mortgage
payments, your lender will probably take you to court. You cannot
be evicted from your home without a court order. Court procedures
are the same for first and second mortgages.
Court summons
If you have not reached an agreement with your
lender and they seek possession then they must apply to the County
Court. A Court Summons will be issued and you will be told of the
time and date of the court hearing. Seek advice when you get your
court papers.
- Always
attend the hearings.
- Always reply
to court
papers.
