Homelessness and Threatened Homelessness

You are homeless if:

  • you have no accommodation in the UK or elsewhere or;
  • you have accommodation but cannot gain entry to it or:
  • you live in a moveable structure and there is nowhere for you to place it and reside in it.

You may also be homeless if you have accommodation but it is not reasonable for you to continue to occupy it. A property can be unreasonable to continue to occupy for many reasons, for example, because it is not affordable, or it is in poor condition or it is probable that you or a person who lives with you will experience or fear violence.

You are threatened with homelessness if it is likely that you will become homeless within 28 days. If the Council is satisfied that you are homeless or threatened with homelessness, it then has to consider if you have a priority need for accommodation.

If I apply to the council as homeless or threatened with homelessness, how will my application be considered? Who will be treated as in priority need?
Who is eligible for assistance? Duty to secure accommodation
What happens if the council has no duty to assist me with accommodation? What assistance is available to help me obtain accommodation in the private sector?
What can I do if I disagree with the council's decision? Where can I obtain further advice?
