Benefits - Non-Dependants


A non-dependant is someone who normally lives with you as part of your household, such as an adult child (i.e. where Child Benefit is no longer paid), relative, friend or a person treated as not liable to make payments in respect of the property you live in.

Non-dependants do not include boarders, sub-tenants or joint tenants.

Non-dependants cannot claim Housing Benefit for any payments they pay towards their living costs; any money that the claimant receives from the non-dependant will not be treated as an income for the claimant.

If you have a non-dependant living with you, then there is normally a deduction from the amount of benefit that you are entitled to. The amount of deduction that we take, will depend on your non-dependant's income. (If you have two non-dependants living as a couple their incomes will be combined and only one deduction will be taken)

There are exceptions when a non-dependant deduction will not be taken from the claimants benefit.

If the claimant or any partner are:

  • Registered blind or recently gained their sight
  • In receipt of Disability Living Allowance (Care Element) or Attendance Allowance

Or if the non-dependant comes under the following:

  • If they are under the age of 18 (HB and CTB)
  • If they are under the age of 25 and in receipt of Job Seekers Allowance (Income Based) or Income Support (HB and CTB)
  • If they are under the age of 25 and are in assessment phase only (first 13 weeks) of Employment Support Allowance (Income Related) (HB only)
  • If they are under the age of 25 and in any phase of Employment Support Allowance (Income Related) (CTB only)
  • If they are in receipt of Pension Credit (HB and CTB)
  • If they are over the age of 25 and receipt of Job Seekers Allowance (Income Based) or Income Support or Employment Support Allowance (Income Related) (CTB only)
  • If they are a student (there is an exception to when a non-dependant deduction is taken during Summer holidays, but only HB)
  • If they are a youth trainee
  • If they have gone into prison or in similar forms of detention
  • If they are in hospital for 52 weeks or more
  • If their home is normally somewhere else
  • If the non-dependant falls within any of the groups who are "disregarded persons" for Council Tax purposes (CTB only)

Below are the weekly tables for Housing Benefit and Council Tax Benefit Non-Dependant Deductions that are taken for April 2011 to Mar 2012:
